Please read these terms carefully before using the Vision View 360 website or hiring us for any digital marketing service.
Last updated: 18 October 2026
1. Acceptance of Terms
By visiting visionview360.com, submitting a form, or engaging Vision View 360 (“we”, “us”, “our”, “Agency”) for any service, you (“Client”, “you”, “User”) agree to these Terms and Conditions. If you do not agree, please do not use the website or our services.
You confirm that you are at least 18 years old and, if you act for a business, that you have the authority to bind that business to these terms.
These terms are an electronic record under the Information Technology Act, 2000 and the Indian Contract Act, 1872. They do not need any physical or digital signature to be valid.
2. About Us and Our Services
Vision View 360 is a digital marketing agency based in Jaipur, Rajasthan, India, serving businesses across India. Our services may include:
- Local SEO and Google Business Profile optimization
- Website SEO
- Meta (Facebook and Instagram) Ads and Google Ads management
- Website design and development
- Social media management and content creation
- Any other service agreed in writing (proposal, quotation, invoice, email or WhatsApp confirmation)
The exact scope, deliverables, timeline, number of revisions and fees of each project are as stated in the proposal or invoice you accept. Anything outside that scope is treated as additional work and may be charged separately. We may decline a project if it does not suit our services or breaks the law or platform rules.
3. Website Use
You agree to use this website only for lawful purposes. You must not:
- Attempt to hack, disrupt, scrape or overload the website or its forms
- Submit false, misleading or another person’s information
- Copy, resell or republish our content without written permission
- Use the website in violation of any applicable Indian law
The information on this website is for general guidance and may be updated at any time without notice. The website is provided on an “as is” basis, and we do not promise that it will always be available or free of errors.
4. Client Responsibilities
To deliver good work on time, you agree to:
- Provide accurate business details, logos, images, access and approvals promptly
- Give us the access we need to your website, ad accounts, Google Business Profile and social pages
- Make sure you own, or have the right to use, all material you give us
- Make sure your products, services and claims are legal and follow advertising rules, including the ASCI guidelines, the Consumer Protection Act, 2019 and the advertising policies of Meta, Google and other platforms
- Have lawful consent for any customer phone numbers, emails or lists you ask us to use for messaging or audiences
Delays in your approvals, content or access will extend the project timeline, and we are not responsible for resulting delays.
5. Account Access and Ownership
Your ad accounts, Business Manager, Facebook and Instagram pages, Google Business Profile, website, domain, analytics and similar assets belong to you and should stay in your name. We work through the access you grant us, preferably using each platform’s own sharing or partner features rather than your passwords. When the engagement ends, we will stop using these accounts, and you should remove our access. We will not lock you out of, or hold back, assets that belong to you, other than as stated in Section 6 about unpaid dues.
6. Fees and Payment
- Fees are as stated in the proposal or invoice, in Indian Rupees (INR).
- GST and other applicable taxes are charged extra unless clearly stated as included. We issue a tax invoice for each payment where applicable.
- One-time projects: 50% advance before work starts and the balance before final delivery or go-live, unless agreed otherwise.
- Monthly retainers: payable in advance, on or before the due date shown on the invoice.
- Late payments may attract a late fee of 2% per month and may result in work being paused.
- Payment can be made by bank transfer, UPI or other methods we confirm in writing.
- We may hold final files, login handover or published work until all dues are cleared.
- Work outside the agreed scope is quoted separately and starts only after you approve it.
7. Advertising Budgets
Money you spend on ads (Meta, Google or any other platform) is separate from our service fee. Ad spend is paid directly by you to the platform, or collected in advance by us if agreed in writing, and is used only for your campaigns. We will not spend more than the budget you approve. Platform charges and taxes on ad spend, such as GST, are payable by you.
Ad spend already used by the platform is non-refundable by us, because it is charged by the platform and not by us.
8. Refund and Cancellation
Because our work is time-based and starts as soon as a project is accepted, the following policy applies:
- Advance and booking amount: non-refundable once work, research or planning has started.
- Before any work begins: if you cancel in writing before we start, we may refund the amount paid after deducting 10% as administrative cost and any expenses already incurred.
- Completed or delivered work: fees for work already delivered or in progress are non-refundable.
- Monthly retainers: you may cancel with 30 days’ written notice. The current month’s fee is not refundable. No partial-month refunds are given.
- Ad spend, domain, hosting, plugin, theme and other third-party purchases: non-refundable.
- Our error: if we fail to deliver the agreed scope because of our own fault, we will first try to correct it free of charge within a reasonable time. If we still cannot, a proportionate refund for the undelivered part may be considered.
- Refund requests must be sent in writing to hello@visionview360.com. Approved refunds are processed within 7 to 10 working days to the original payment method.
9. No Guarantee of Results
Digital marketing depends on many factors outside our control, such as search engine algorithms, platform policy changes, competition, your pricing, product quality, how quickly you respond to enquiries, and market conditions.
- We do not guarantee any specific ranking, traffic, number of leads, sales, followers, return on ad spend or revenue.
- Any timeline, estimate or example we share is an expectation, not a promise.
- Ads may be rejected, and ad accounts, pages or listings may be restricted or suspended, by the platform. We are not liable for such decisions, but we will help with appeals where possible.
10. Content and Intellectual Property
- Your materials: logos, text, images and data you provide remain yours. You allow us to use them to deliver the services.
- Our work: after full payment, you receive the right to use the final deliverables (designs, copy, website) for your business. Until full payment, ownership stays with us.
- Our tools and methods: templates, processes, internal documents and know-how remain our property.
- Portfolio: unless you object in writing, we may show completed work, without confidential data, in our portfolio.
- You are responsible for confirming that content, fonts, music and images you supply are properly licensed. Stock or licensed assets we buy for you are subject to their own licence terms.
11. Third-Party Platforms and Tools
Our services rely on third-party platforms such as Google, Meta, WordPress, hosting providers and payment gateways. Their terms, policies, pricing and availability apply to you and may change at any time. We are not responsible for downtime, errors, data loss or policy changes made by these third parties.
12. Confidentiality and Privacy
We treat your business information, login details and customer data as confidential and use them only for your project. We may share them only with team members or tools needed to deliver the service, or when required by law. This duty continues after the engagement ends, except for information that is already public or that you have asked us to share.
We collect only the information you submit through our forms or share with us (such as name, phone, email and business details). We handle personal data in line with the Digital Personal Data Protection Act, 2023 and our Privacy Policy. We do not sell your personal data.
You are responsible for keeping your own passwords safe and for removing our access when the engagement ends.
13. Indemnity
You agree to protect us against claims, losses and expenses, including reasonable legal fees, that arise from: the content, products, services or claims you give us or approve; your breach of these terms or of any law; or your use of materials you supplied without the right to do so. We will tell you promptly about any such claim and work with you to deal with it.
14. Limitation of Liability
To the maximum extent allowed by law:
- We are not liable for indirect, incidental or consequential losses, including loss of profit, business, data or goodwill.
- Our total liability for any claim is limited to the fees you paid us for the specific service in the 3 months before the claim arose.
- We are not responsible for losses caused by events beyond our reasonable control (force majeure), such as internet or power failure, natural disaster, government action or platform outage.
Nothing in these terms removes any right you have under applicable consumer protection law that cannot be excluded.
15. Termination
Either party may end the engagement with written notice as per Section 8. We may suspend or end services immediately if you:
- Do not pay dues on time
- Break these terms or supply illegal, misleading or abusive content
- Behave abusively towards our team
On termination, you must pay for all work done up to that date. The sections on payment, intellectual property, confidentiality, indemnity, liability and governing law continue after termination.
16. Governing Law and Disputes
These terms are governed by the laws of India. We prefer to solve any disagreement through friendly discussion first. If it cannot be resolved within 30 days, the dispute may be referred to arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator and the seat in Jaipur, Rajasthan, in English or Hindi.
Subject to the above, the courts at Jaipur, Rajasthan have exclusive jurisdiction.
17. General Provisions
- Entire agreement: these terms, together with any signed proposal, quotation or agreement, are the complete agreement between us. If a signed proposal or agreement differs from this page, the signed document prevails.
- Severability: if any part of these terms is found invalid, the rest stays in force.
- No waiver: if we do not enforce a right immediately, we do not lose it.
- Assignment: you may not transfer your rights or duties under these terms without our written consent.
- Relationship: we are an independent service provider. Nothing here makes us your employee, partner or agent.
- Communication: you agree that we may contact you and send notices by email, phone or WhatsApp using the details you gave us.
18. Changes to These Terms and Contact
We may update these terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Continuing to use the website or our services after an update means you accept the changes.
